These Terms of Service ("Terms") govern your use of the Ka-Plow Outdoor Services website and the services we provide. By accessing our website or engaging our services, you agree to these Terms.
1. Services & Scope
Ka-Plow Outdoor Services, operating under Green Cabbage Ventures LLC, provides residential and commercial outdoor property services in the Minneapolis–Saint Paul metro area. Our service obligations are strictly limited to the physical areas explicitly outlined and agreed upon in your Property Service Overview Map. Any areas not delineated on this map are expressly excluded from service. Services include, but are not limited to:
- Snow plowing, shoveling, and ice management
- Lawn mowing (removing a maximum of 1/3 grass height per visit), edging, and lawn care
- Fertilization, weed control, and aeration
- Spring and fall cleanups
- Landscaping, mulch, and sod installation
- Gutter cleaning, pressure washing, and property maintenance
All services are subject to availability, scheduling, and weather conditions. This website's terms and any signed Landscaping Maintenance Agreement supersede all prior oral or written agreements.
2. Estimates & Pricing
Estimates provided via our website, phone, or in person are good-faith approximations based on the information available at the time. Final pricing may vary due to actual property conditions, scope changes, or unforeseen circumstances. We will communicate any significant price adjustments before proceeding whenever possible. Any additional winter services not explicitly listed in your schedule will be billed at our standard hourly equipment and labor rates.
3. Payment Terms
- Payment is due upon completion of services unless a prior written agreement specifies otherwise.
- We accept checks, Visa, Mastercard, Discover, American Express, PayPal, Venmo, and ACH transfers.
- A convenience fee applies to credit and debit card transactions processed through our online payment portal.
- Accounts past due by more than 30 days may be subject to a late fee and suspension of service.
- Returned checks are subject to a $35 returned check fee.
4. Scheduling & Cancellations
- Customers requesting on going seasonal services are required to sign a service agreement for the duration of the requested service period.
- Service schedules are subject to change due to weather, equipment issues, or other circumstances beyond our control.
- Ka-Plow reserves the right to perform winter services during overnight hours (11:00 PM to 7:00 AM). Delaying service until the morning does not constitute a failure to perform, and the customer accepts any noise generated during these hours.
- Snow services are dispatched automatically based on trigger depths and weather forecasts. No call or notification is required from the customer.
- Ka-Plow reserves the right to cancel or suspend services for non-payment, unsafe property conditions, or conduct toward staff.
5. Property Access & Conditions
- Customer must maintain the work site in a reasonably safe condition and warn us of any known latent defects, structural instabilities, or hidden hazardous conditions prior to service.
- Customer is responsible for ensuring clear access to the service area, including removing vehicles and obstacles. Customer must mark all obstacles at the start of each season.
- We are not responsible for missed trash pickups resulting from uncleared snow or debris within the interior of waste enclosures, nor any resulting fines or overflow fees.
- Normal wear to turf or landscaping as a result of plowing operations in severe winter conditions is not considered damage.
6. Subcontractors & Indemnification
Protection under these terms extends specifically to all Subcontractors engaged by Ka-Plow Outdoor Services. We are not responsible for the negligent acts or omissions of independent subcontractors. In the event of property damage caused by a Subcontractor, your sole and exclusive remedy is to seek recovery directly from that Subcontractor or their insurance. Customers agree to indemnify and hold harmless Ka-Plow Outdoor Services against claims arising from negligent acts of the customer, failure to maintain safe premises, or undisclosed pre-existing hazards.
7. Limitation of Liability & Damage Claims
We exercise due care; however, Ka-Plow Outdoor Services and its Subcontractors will not be held liable for damage caused by the following:
- General debris, loose paving materials, or ice being struck and displaced by snow removal equipment.
- Equipment striking hidden protrusions obscured by snow (e.g., sod, retaining walls, fencing, landscaping).
- Damage to paving surfaces (interlock, concrete, pavement) resulting from normal contact with snow removal equipment.
- Scratches or abrasions to garage doors or adjoining areas contacted by snow shoveling tools.
- Changes in weather severity or frost damage.
Damage Claim Procedure: Customers must notify Ka-Plow Outdoor Services in writing within twenty-four (24) hours of discovering any property damage alleged to be caused by our services. We are not liable for any damages unless given the opportunity to investigate. If liability is accepted, Ka-Plow Outdoor Services retains the first right to repair the damage according to industry standards.
8. Website Use
This website is provided for informational and transactional purposes only. Unauthorized use of this site — including automated scraping, attempts to access restricted areas, or submission of fraudulent information — is strictly prohibited and may be reported to law enforcement.
9. Governing Law
